A Federal High court sitting in Abuja has struck out a ligation by Prince Collins Eselemo, challenging the candidature of Nicholas Mutu, the Peoples Democratic Party, PDP, standard for the Bomadi/Patani Federal Constituency in the 2023 polls.
The judge, Justice Omotosho Kolawole said the case was dismissed for lack of merit.
Eselemo challenged Nicholas for holding fake certificate and he should thereby be disqualified from contesting the 2023 general elections.
The trial, Justice Kolawole in his verdict, noted that the complainant lacked the locus standi to file the suit against Mutu’s nomination as he didn’t contest in the PDP primary elections.
He furthered that only those expressly cited in sec. 29(5) of the Electoral Act have exclusive right to litigate based on that provision.
He, however, described the plaintiff as a “meddlesome interloper.”
The judge maintained that the plaintiff has not substantially proved that the 1st defendant holds a fake certificate, noting that he must present the original or the alleged invalid false document before the court for examination.
In his comment, Mutu appreciated the Almighty, expressing absolute confidence in the Nigerian judicial system.
